Securing a Legacy for a Blended Family
John (63) and Emily (58) are a married couple with a blended family. Emily has two adult children, Kaitlyn (32) and Michael (30), from a previous marriage, and they share a daughter, Mia (23). Both John and Emily have brought significant retirement savings, including pensions and seven-figure retirement accounts, into their marriage. Their priority is to ensure a secure retirement for the surviving spouse and a fair and equitable distribution of their assets to all three children.
The Problem
While John and Emily’s current advisor has done well managing their investments, crucial issues related to their blended family dynamics, estate planning, and tax efficiency have not been addressed. They are concerned about what might happen if one spouse passes away first, leaving the surviving spouse in full control of the assets, potentially leading to an unintended disinheritance of Emily’s children from her previous marriage. Without proper planning, their assets could be distributed in a way that creates family tension or an inequitable outcome.
John and Emily also have concerns about securing their own retirement. They want a clear plan for the surviving spouse’s financial security, ensuring that assets can be accessed in a tax-smart manner while maintaining the overall wealth for legacy purposes.
The Discovery
Upon review, it was clear that while their investments had grown under their current advisor, key elements of their financial plan were missing. Their retirement savings were concentrated in tax-deferred accounts, which would trigger Required Minimum Distributions (RMDs) and create tax burdens down the road. Additionally, they lacked an estate plan to ensure that all three children would receive their intended share of the inheritance fairly and equitably.
Emily also expressed uncertainty about her ability to retire comfortably, especially without a comprehensive financial plan that accounted for long-term cash flow and potential state tax burdens on their estate. These concerns were compounded by the absence of structured legal documents such as wills, powers of attorney, and trusts.
The Solution
We developed a tailored financial and legacy plan, working collaboratively with an estate planning attorney to ensure that their wishes were implemented legally and efficiently. First, we recommended establishing a trust to protect the interests of all three children and prevent the surviving spouse from unintentionally disinheriting any of them. This would ensure a fair and equitable distribution of assets, regardless of who passes away first, and address Emily’s concern about safeguarding her children from a previous marriage.
Additionally, we structured a Roth conversion strategy to reduce the future impact of RMDs, allowing John and Emily to minimize their tax burdens and preserve more of their wealth for both retirement and legacy purposes. This approach allowed them to maintain tax-efficient access to funds for the surviving spouse while protecting the bulk of their assets for inheritance.
A thorough retirement analysis provided clarity on Emily’s ability to retire early if desired, with a focus on securing enough income for both spouses. This analysis also included provisions for ongoing financial support for any child without jeopardizing the couple’s overall retirement plan.
Conclusion
John and Emily now have a comprehensive plan that is intended to provide them with peace of mind. Our goal was to implement strategies designed to ensure that the surviving spouse is financially protected. By using trusts and strategic planning, their children will receive an equitable inheritance. Our objective was to preserve their legacy in a tax-efficient manner. By addressing both financial and legal issues, we believe they will look forward to retirement with confidence, knowing that their wishes will be honored and they’ve prepared for their family’s financial future in a fair manner.
